This Privacy Policy explains how Discovery Communications, LLC and/or its subsidiary and affiliated entities (“we,” “us,” “our” or “Discovery”) collects, uses, and discloses information about you (“user” or “you”) through our Discovery social good campaign websites (collectively, the “Site” or “Sites”) or when you otherwise interact with us in relation to the campaigns. Please read this Privacy Policy carefully.

We reserve the right to make changes to this Privacy Policy from time to time. If we make changes, we will alert you about any changes by updating the “Last Updated” date of this Privacy Policy, and in some cases, we may provide you with additional notice (such as adding a statement to our homepage or sending you a notification). We encourage you to review the Privacy Policy whenever you access the Site or otherwise interact with us to stay informed about our information practices and the choices available to you.  

1.              Who May Use the Site.

The Site is not intended for use by children under the age of 13. We do not knowingly collect personal information from children under 13. In the event that we learn that we have collected personal information from a child under the age of 13, we will delete it. If you believe that we might have collected personal information from a child under 13, please contact us using the information in the “Contact Us” section below.

2.              Collection of Information.

·      Information you provide to us:

When you sign up for our newsletter, campaign events or volunteer events, request additional information about the campaign or donate to the campaign, we may ask you to provide certain information such as your name, phone number, zip code and email address. We also collect information when you request customer support or otherwise communicate with us, or any other information you choose to provide to us. When you use our “Text to Donate” SMS service, there may also be additional information obtained from you including your cell phone number, your carrier’s name, and the date, time and content of your messages. We use a third-party intermediary to process all donations made through the Site or through our “Text to Donate” SMS service. You may be required to enter payment information in order for our third-party intermediary to process your donation through the Site. This third-party may disclose information about you with us so that we can contact you and provide the services you request from us. Any information collected about you through our third-party intermediary is subject to that third party’s privacy policy and data security practices. 

·      Information about your use of the Site:

Automatically Collected Information

When you access or use the Site, we automatically collect information about you, including:

o   Log Information:  We collect log information about your use of the Site, including the type of browser you use, app version, access times, pages viewed, your IP address and the page you visited before navigating to the Site.

o   Information Collected by Cookies and Other Tracking Technologies:  We use different technologies to collect information, including cookies and web beacons. Cookies are small data files stored on your hard drive or in device memory that help us improve the Site and your experience, see which areas and features of the Site are popular and count visits. Web beacons are electronic images that may be used in the Site or emails and help deliver cookies, count visits and understand usage and campaign effectiveness. ·      Information from other sources:

We may obtain information from other sources and combine that with the information described above. For example, we may collect information about you from third parties and publicly available sources.

3.              Use of Information.

We use the information we collect to provide, maintain, and improve the Site, to market our products, services and programs, to deliver the services you request and customize your experience with us, to process your newsletter subscription and to communicate with you on these and other topics. We may also use the information we collect to:

·      Send you technical notices, updates, security alerts and support and administrative messages and to respond to your comments, questions and customer service requests or to notify you about material changes to this Privacy Policy;

·      Communicate with you about services, offers, events, volunteer opportunities and events offered by Discovery and others, and provide news and information we think will be of interest to you;

·      Monitor and analyze trends, usage and activities in connection with the Site;

·      Detect, investigate and prevent fraudulent transactions and other illegal activities and protect the rights and property of Discovery and others;

·      Personalize and improve the Site and provide content or features that match user profiles or interests; and

·      Carry out any other purpose described to you at the time the information was collected.

4.              Disclosure of Information.

We may disclose information about you as follows or as otherwise described in this Privacy Policy:

·      With vendors, consultants and other service providers who need access to such information to carry out work on our behalf, such as third parties with whom we may disclose your information to track and analyze non-identifying aggregate usage and volume statistical information from our visitors; 

·      With our third-party payment intermediaries to process donations or with the non-profit organizations we partner with as part of our campaigns;

·      In response to a request for information if we believe disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements;

·      To protect the rights, property and safety of Discovery or others;

·      In connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business by another company;

·      Between and among Discovery and our current and future parents, affiliates, subsidiaries and other companies under common control and ownership; and

·      With your consent or at your direction.

We may also disclose aggregated or de-identified information, which cannot reasonably be used to identify you. For example, we may disclose a hashed version of your email address to facilitate customized ad campaigns on other platforms.

5.              Advertising and Analytics Services Provided by Others.

We may allow others to provide analytics services and serve advertisements on our behalf across the internet and in applications. These entities may use cookies, web beacons, device identifiers and other technologies to collect information about your use of the Site and other websites and applications, including your IP address, web browser, mobile network information, pages viewed, time spent on pages or in apps, links clicked and conversion information. This information may be used by Discovery and others to, among other things, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests on the Site and other websites and better understand your online activity. As described above, we use Google Analytics to provide us with analytics services to evaluate use of the Site. 6.              Third Party Sites

The Services contain links and pages to other websites operated by third parties. Please note that this privacy policy applies only to the personal information that we collect through the Services and we cannot be responsible for personal information that third parties may collect, store and use through their website. 7.        Your Privacy Rights

Depending on your state of residence, applicable law may allow you to make certain requests about your “personal information” or “personal data” (as such terms are defined under applicable law, and collectively referred to herein as “personal information”). Specifically, you may be permitted to request us to:

·   Inform you about the categories of personal information we collect or disclose about you; the categories of sources of such information, the business or commercial purpose for collecting your personal information, and

the categories of third parties with whom we disclose personal information;

·   Provide access to and/or a copy of certain personal information we hold about you;

·   Opt out of the sale of your personal information;

·   Opt out of the processing of your personal information for targeted advertising purposes;

·   Request correction of your personal information; and

·   Provide you with information about the financial incentives that we offer to you, if any.

Please note that certain information may be exempt from such requests under applicable law. For example, we need certain information in order to provide the Services to you.

Verification: We will take reasonable steps to verify your identity before responding to a request, which may include, at a minimum, depending on the sensitivity of the information you are requesting and the type of request you are making, verifying your name, e-mail address, and physical address.

You may also be permitted to designate an authorized agent to submit certain requests on your behalf. In order for an authorized agent to be verified, you must provide the authorized agent with signed, written permission to make such requests or a power of attorney. We may also follow up with you to verify your identity before processing the authorized agent’s request. If we deny your request in whole or in part, you may have the right to appeal the decision. In such circumstances, we will provide you with information regarding the appeals process.

8.              Additional Privacy Information for California Residents.

If you are a California resident, California law requires us to provide you with some additional information regarding the “personal information” (as defined in the California Consumer Privacy Act (“CCPA”)) we collect from and about you, and your rights with respect to your personal information. 9.              Additional Privacy Information for European Union ("EU") Residents.

  • If you are based in the EU, EU law requires us to provide you with additional information regarding your personal information and your rights, as follows: Data controller. The data controller in respect of your information is Discovery Communications, LLC, registered in Maryland in the United States of America whose registered office is at 8403 Colesville Road, Silver Spring MD 20910, United States.
  • Data Protection Officer. You can contact our Data Protection Officer by emailing DPO@discovery.com.
  • Your personal information. Your name, email and payment information will be collected through our donation processor partner. We will store and use your personal information because it is required in our legitimate interests in order to accept your donation and for us to comply with our legal obligations.
  • Consent. We also store and use your personal information to send you further communications if you have provided your consent for us to do so when you make your donation. If you change your mind, you may withdraw your consent at any time, as set out in a communication or otherwise by contacting our Data Protection Officer.
  • Transfers outside of the EEA. We may transfer your personal information to countries outside of the European Economic Area ("EEA"), for the above purposes. If we do this, we will:
    • include the standard contractual data protection clauses approved by the European Commission into our contracts with the recipients; or
    • ensure that the country in which your personal information will be handled has been deemed "adequate" by the European Commission under the General Data Protection Regulation; or
    • where appropriate, ensure that the recipient is part of the Privacy Shield.

  • Data retention. We will retain information (including personal information) for as long as we need to use it for the reasons set out in this privacy policy. You have the right to request that we: (a) provide access to any personal information we hold about you; (b) update any of your personal information which is out of date or incorrect; (c) delete any personal information which we are holding about you; (d) restrict the way that we process your personal information; (e) prevent the processing of your personal information for direct-marketing purposes; provide your personal information to a third party provider of services; (f) provide you with a copy of any personal information which we hold about you; and (g) consider any valid objections which you have to our use of your personal information. We will respond within a reasonable time period and let you know if any information may be exempt. We may need to confirm your identity before responding to any request you make.
  • Complaints. If you believe your rights have been breached or we have not complied with data protection laws, you may make a complaint to our supervisory body for data protection matters or seek a remedy through local courts. The relevant supervisory body will depend on where you are located.

This Privacy Notice for California residents supplements the projectcat.discovery.com Privacy Policy. This Notice applies to website visitors, app users, and customers in California. B. California Information & Deletion Rights

C. Notice of Right to Opt-Out of Sale of Personal Information

California residents may opt out of the “sale” of their personal information. Under the CCPA, “sale” is broadly defined to mean the disclosure of personal information with third parties who are not acting as our service providers or who are otherwise not restricted from using data only on our behalf or pursuant to an applicable CCPA exception.

In some circumstances, we may disclose certain of your information with third parties to provide you with offers, promotions, and opportunities that may be of interest to you, which may be considered a “sale” under the CCPA. Under the CCPA, “sale” may also include allowing third parties to “collect” certain information, such as IP address, and/or browsing behavior, through cookies and similar technologies, to deliver targeted advertising on the Services or other services. Advertising, including targeted advertising, enables us to provide you certain content for free and allows us to provide you offers relevant to you.

The CCPA also allows California residents to opt out of the “sharing” of their personal information for “cross-context behavioral advertising.” Under the CCPA, this activity is defined as the targeting of advertising to a consumer based on that consumer’s personal information obtained from the consumer’s activity across websites. We “share” information for these purposes to provide more relevant and tailored advertising to you regarding our Services and the services of our partners.

If you would like to opt out of our use of your information for such purposes that are considered a “sale” or “sharing” under California law, you may do so by clicking the “Do Not Sell or Share My Personal Information” link in the footers or app settings menus of our Services.  Please note that we do not knowingly sell the personal information of minors under 16 years of age without legally-required affirmative authorization. Please note that we respond to and abide by browser-based opt-out preference signals. Any opt out preferences you have exercised through these methods will only to the browser on which you made them. The CCPA further provides you with the right to not be discriminated against (as provided for in applicable law) for exercising your access, deletion or sale/sharing opt out rights.

The CCPA also allows you to limit the use or disclosure of your “sensitive personal information” (as defined in the CCPA) if your sensitive personal information is used for certain purposes. Please note that we do not use or disclose sensitive personal information other than for purposes for which you cannot opt out under the CCPA.

D. Retention of Your Personal Information

We will only retain your Information for as long as is necessary for the purposes described in this Privacy Notice. This means that the retention periods will vary according to the type of Information and the reason that we have collected the Information in the first place. In determining how long to retain information, we consider the amount, nature and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of the information, the purposes for which we process the information, applicable legal requirements, and our legitimate interests. The purposes for which we process information (as well as the other factors listed above) may dictate different retention periods for the same types of information. For example, if you purchase a subscription to one of our paid services, we will retain your payment history records for a period of time after you’re your purchase for our anti-fraud and legal compliance purposes. If you opt out of email marketing, we maintain your email on our suppression list indefinitely to comply with your request. We may delete or de-identify your information sooner if we receive a verifiable deletion request, subject to exemptions under applicable law. We may retain cached or archived copies of your information.

E. California “Shine the Light” Disclosure

If a company shares “personal information” (as defined in California’s “Shine the Light” law, Civil Code § 1798.83) with third parties for their direct marketing purposes (e.g., to send offers and information that may be of interest to you), California law requires either providing a mechanism by which consumers can obtain more information about such sharing over the prior calendar year, or providing a mechanism by which consumers can opt out of such sharing. As discussed above, we provide an opt out for this sharing.
